MOTOR VEHICLE ACCIDENTS BEFORE 1 DECEMBER 2017

If you have been injured in a Motor Vehicle Accident in New South Wales  you may be entitled to compensation through the Compulsory Third Party Scheme (CTP). You may be familiar with this as “Green Slip Insurance.” This is different from Property Damage Insurance.

Your entitlements will depend on whether you were injure before or after 1 December 2017.  The information on this page only applies to motor vehicle accidents which occurred prior to the 1 December 2017.  For all accidents occurring after the 1 December 2017 please seek legal advice immediately because the law has changed.  Strict time limits apply.  We will be providing information about your entitlements under the Motor Accident Injuries Act 2017 on this website in the near future.

Motor Vehicle Accident Claims in NSW  which occurred before 1 December 2017 are governed by the Motor Accident Compensation Act (1999). Strict time limits apply to the making of Motor Vehicle Accident claims in NSW and it is therefore essential to seek legal advice as soon as possible after suffering the injury.

The Motor Vehicle Accident must be reported to the Police within 28 days and you should obtain an Event Number. Failure to report the accident to the police within the prescribed time limits may result in the CTP Insurer rejecting the claim. If you have been injured in a Motor Vehicle Accident over 28 days ago and have not yet reported it to the police you should do so immediately. The CTP Insurer may require a Statutory Declaration explaining the delay in reporting the accident to the police. You should seek legal advice immediately to assist you in preparing the Statutory Declaration.

A Personal Injury Claim Form must be lodged with the relevant CTP Insurer within 6 months of the date of injury. The relevant CTP insurer is the CTP Insurer of the vehicle at fault in the accident. Although a “late claim” can be made, this can be a time consuming and difficult process with no guarantee that your claim will be accepted by the CTP Insurer. If you were injured over 6 months ago and have not yet lodged a Personal Injury Claim Form you should seek legal advice immediately.
